Terms of Use

1. Acceptance of Terms

By downloading, accessing, or using the Baby Soother Mom's Voice mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms apply to all users of the App, including parents, guardians, and caregivers.

2. About Us

The App is operated by ZenTech-Studio, a sole proprietorship owned by Muhammad Omer Khan("Owner", "we", "us", "our", or "Service Provider"), with its principal place of business at:

3. Eligibility

By using this App, you represent that you are at least 18 years of age or are using the App under the supervision of a parent or legal guardian. If you are under 18, you may only use the App with the consent of a parent or guardian. The App is intended for adult use to soothe infants and is not directed at children under 13.

4. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal Android or iOS device(s)
• Use the App for personal, non-commercial purposes (soothing your baby)
• Record your voice for personal use within the App

You may NOT:

• Copy, modify, reverse engineer, decompile, or disassemble the App's code (except where permitted by mandatory law)
• Extract, redistribute, or sell any included sound recordings outside the App
• Translate the App into other languages (unless we provide localization options)
• Create derivative works or competing products
• Remove any copyright, trademark, or attribution notices

5. Intellectual Property

5.1 Our Own IP

All rights, title, and interest in the App's original elements, including software code, design, layout, user interface, graphics (excluding sounds), logos, trademarks, and database structure, are owned by ZenTech-Studio or its licensors.

5.2 Official App Content: Credits & Licenses

This applies only to the built-in instant sounds provided within the App (white noise, fan, heartbeat, rain, etc.).

These audio assets are legally sourced from Freesound.org under the CC0 1.0 Universal license. The original creators have waived all rights. No copyrighted material is infringed.

You may not extract or redistribute these sounds separately.

This does not apply to your personal voice recordings.

5.3 Your Voice Recordings

All voice recordings you create using the App (e.g., mom's voice, lullabies, custom sounds) are owned by you.

• We do not claim any ownership or license to your recordings
• Recordings are stored locally on your device only
• You are responsible for backing up your recordings

5.4 AI and Data Scraping Prohibition

You may not scrape, extract, index, harvest data from the App, nor use the App or any content from it to train or develop machine-learning or AI models.

5.5 Reservation of Rights

All rights not expressly granted to you are reserved by ZenTech-Studio and the respective third-party sound creators.

6. User Conduct

You agree NOT to:

• Use the App for any illegal purpose
• Upload or record inappropriate, offensive, or harmful content
• Attempt to reverse engineer, decompile, or modify the App
• Interfere with or disrupt the App's functionality
• Use the App to violate any applicable laws or regulations
• Share your voice recordings outside the App without proper consent

7. Voice Recordings

When you record your voice using the App, the following terms apply:

• Recordings are stored locally on your device only
• You retain all ownership rights to your voice recordings
• We do not access, upload, or store your recordings on our servers
• You are responsible for backing up your recordings
• Recordings are deleted when you uninstall the App, clear App data, or delete the Music/BabySoother/ folder

8. Pricing Model

The App is currently completely free to download and use. All features, including soothing sounds (white noise, fan, heartbeat, rain) and voice recording capabilities, are available at no cost.

There are no subscription plans, in-app purchases, or premium tiers at this time.

Future Changes: If we ever introduce paid features, we will update these Terms with at least 30 days advance notice and notify you via in-app notification or email. You will never be charged without your explicit consent.

9. No Paid Transactions

Because the App does not currently process any payments or subscriptions, no refund policy applies. If this changes in the future, this section will be updated accordingly.

11. Platform Operator Disclaimer

These Terms are between you and ZenTech-Studio, not with Google Play, Apple App Store, or any other app store. The app store operators are not responsible for the App or these Terms.

12. Geographic Restrictions

The App is operated from Pakistan. Access from territories where the App or its content is illegal or restricted is prohibited. If you access the App from outside Pakistan, you do so at your own initiative and are responsible for compliance with local laws.

13. Third-Party Services

The App integrates third-party services:

• Google Play Services / Apple App Store
• Google Analytics for Firebase
• Firebase Crashlytics

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party content or practices.

14. Third-Party Websites

The App may contain links to third-party websites. We are not responsible for their content, privacy practices, or terms.

15. Internet, Data, and Roaming Charges

An internet connection is required for analytics and crash reporting. You are responsible for any data charges, roaming fees, or other costs charged by your mobile provider. If you are not the bill payer, we assume you have obtained permission.

16. Device Security

Do not jailbreak or root your phone. Doing so compromises security features and may expose you to malware or data theft. We are not responsible for damage resulting from a jailbroken or rooted device.

17. Updates and Availability

We may release updates to improve functionality or fix bugs. You agree to accept updates. We do not guarantee the App will work on all Android/iOS versions or devices.

We reserve the right to discontinue the App with reasonable notice (e.g., 30 days via in-app notification or email). If discontinued, your license ends and you must uninstall the App.

18. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY SOUND WILL SOOTHE YOUR BABY.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZENTECH-STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, BATTERY DRAIN, OR RELIANCE ON THE APP'S EFFECTIVENESS.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO USE THE APP (CURRENTLY $0) OR (B) $0 USD.

20. Your Warranties

You warrant that your use of the App complies with these Terms, all applicable laws, and does not infringe any third-party rights.

21. Indemnification

You agree to indemnify and hold harmless ZenTech-Studio from any claims, damages, or expenses arising from your violation of these Terms or misuse of the App.

22. Termination

We may terminate or suspend your access to the App immediately, without notice, for violation of these Terms. Upon termination, your right to use the App will cease immediately and you must uninstall the App.

23. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

24. Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

25. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of Pakistan, without regard to conflict of law principles.

Any dispute shall first be attempted through good-faith negotiations. If unresolved within 30 days, the dispute shall be submitted to binding arbitration in Rawalpindi, Pakistan.

26. Changes to Terms

We may update these Terms periodically. If changes are material, we will notify you by updating the "Last Updated" date and providing in-app notice where feasible. Your continued use after the effective date constitutes acceptance of the modified Terms.

27. Entire Agreement

These Terms constitute the entire agreement between you and ZenTech-Studio regarding the App, superseding any prior agreements.
